This privacy policy (hereinafter the “Policy”) describes the manner of collecting, using and otherwise handling personal data obtained through the web interface https://www.marek.eu (hereinafter the “web interface”).

The protection of personal data is very important to us. Please read this Policy carefully, as it contains important information regarding the handling of your personal data and the related rights and obligations.



1. Introductory Provisions

Which rules do we follow when handling personal data?

When handling personal data, we proceed in accordance with the legal order of the Czech Republic and directly applicable regulations of the European Union, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter the “Regulation”), Act No. 110/2019 Coll., on the processing of personal data, as amended, and Act No. 480/2004 Coll., on certain information society services and on amendments to certain acts, as amended.

What are personal data?

Personal data means any information that identifies or may identify a specific natural person. Personal data include in particular (but not exclusively):

  • identification data, such as first and last name, date of birth, identification number and tax identification number (if the person is a natural person – entrepreneur)
  • contact data, such as residential address (or delivery address), telephone number, e-mail address;
  • other data, such as information obtained via cookies, IP address (network identifier) including the type of browser, device and operating system, the time and number of accesses to the web interface, and other similar information.


2. Collection and Use of Personal Data

Providing personal data is a contractual requirement for entering into and performing the purchase contract; without providing them, we cannot process the order and deliver the goods. Providing data for marketing purposes is voluntary.

How do we obtain your personal data?

You provide us with your personal data mainly when completing an order, or when creating a user account. If any of your personal data change, please inform us or update the data in your customer account.

When visiting and using the web interface, certain personal data may also be obtained and stored through cookies. More information about cookies can be found in Article 5 of this Policy.

On what basis and for what purposes do we process your personal data?

  • Personal data entered when inquiring about and ordering goods are processed without your explicit consent for the purpose of entering into and performing the contract (Article 6(1)(b) GDPR), further for the purpose of complying with our legal obligations (Article 6(1)© GDPR – in particular accounting and tax obligations), and on the basis of our legitimate interest (Article 6(1)(f) GDPR) for the purpose of protecting and enforcing our legal claims.
  • Personal data entered when creating a user account may be processed without your explicit consent on the basis of contract performance and exclusively for the purpose of enabling access to, administration and maintenance of the user account.
  • We are entitled to use your e-mail address without your explicit consent under the conditions set out in Section 7(3) of Act No. 480/2004 Coll., i.e., if we obtained your e-mail address in connection with the sale of our goods or services, for the purpose of sending commercial communications relating to our own similar products or services. You may refuse the sending of commercial communications at any time; each commercial communication contains an easy unsubscribe option.
  • If you give us consent by confirming it on the web interface, we may process your personal data entered on the web interface, in particular when completing an order or creating a user account, for the purpose of sending commercial communications and direct marketing, or for other purposes to which you have expressly consented. If you are under 15 years of age, consent must be given by your legal representative. In case of doubt, we may request confirmation of your age.
  • We may use your e-mail address and information about the goods you purchased on the basis of our legitimate interest (Article 6(1)(f) GDPR) for the purpose of checking and improving our services and goods and assessing your satisfaction, via the “Verified by Customers” service of Heureka Shopping s.r.o. Your e-mail address will be passed to the company. You may object to this processing at any time by sending an e-mail to info@marek.eu.
  • If you consent to the transfer of personal data for the purpose of purchase evaluation, we transfer in particular the order identification and your e-mail address to Seznam.cz. It may then use these data to obtain independent reviews of our products. The transferred personal data will be retained only for the period necessary for this use. Consent is voluntary and may be withdrawn at any time in the same ways as other consents to personal data processing.
  • If personal data are processed through cookies, we process necessary cookies without consent because they are required for the operation of the website and for providing the service you request. We process analytical and marketing cookies only on the basis of your consent given via the cookie banner. We use these cookies mainly for user support, improving our services including analysing user behaviour, and marketing.

We process personal data only for the purposes stated above, or for other purposes where permitted by law or where you have given us consent.

Personal data entered in connection with inquiries and ordering goods or registration are used only for the time necessary to perform the contract and comply with legal obligations, or to protect our legal claims.

For how long do we use the data?

We process data for marketing purposes for 5 years from the last order or until consent is withdrawn or an objection is raised, whichever occurs first. We retain accounting and tax documents for 10 years in accordance with the Accounting Act.



3. Your Rights in Relation to Personal Data

Right to withdraw consent to the processing of personal data

If we process your personal data only on the basis of your consent (i.e., without another legal ground), you may withdraw that consent at any time.

Withdrawal of consent to the processing of your personal data is possible at any time, by:

  • e-mail sent to our contact e-mail address: info@marek.eu
  • in person at the branch of MAREK Industrial a.s., Maříkova 2083/32, 621 00 Brno-Řečkovice
  • written communication (e.g., by letter) delivered to the branch address stated above

Withdrawal of consent does not affect the lawfulness of processing carried out prior to the withdrawal.

Right of access to personal data

You have the right to request information as to whether we process your personal data. If we process your data, you have the right of access to such personal data and, in particular, to the following information:

  • purpose of processing
  • categories of personal data processed;
  • recipients or categories of recipients to whom the personal data will be disclosed;
  • period for which the personal data will be stored.

Upon your request, we will provide you with a copy of the processed data. For additional copies, we may charge an administrative fee not exceeding the costs associated with preparing and providing such additional copies.

Right to rectification

If your personal data are inaccurate or incomplete, you have the right to request immediate correction, i.e., the rectification of inaccurate data and/or completion of incomplete data.

Right to object to processing

You have the right to object at any time to the processing of your personal data if we process them for direct marketing purposes, including any automated processing of personal data. After an objection is raised, we will no longer process your personal data for these purposes.

Right to erasure (“right to be forgotten”)

You have the right to request that we erase your personal data if:

  • the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
  • you have withdrawn consent to processing;
  • you have objected to the processing of personal data;
  • the personal data have been processed unlawfully.

If there are no legal grounds for refusing erasure, we are obliged to comply with your request.

Right to restriction of processing

You have the right to request that we restrict the processing of your personal data if:

  • you contest the accuracy of your personal data;
  • processing is unlawful and you request restriction of processing instead of erasure;
  • we no longer need your personal data for the purposes of processing, but you require them for the establishment, exercise or defence of legal claims;
  • you object to processing.

Where processing is restricted, we are only entitled to store your personal data; further processing is possible only with your consent or on legal grounds.

If processing of personal data is restricted due to an objection to processing, the restriction lasts for the time necessary to determine whether we are obliged to comply with your objection.

If processing of personal data is restricted due to contesting the accuracy of the data, the restriction lasts for the time necessary to verify the accuracy of the data.

Right to data portability

You have the right to obtain your personal data that you have provided to us and that are processed by automated means on the basis of consent or contract performance, in a structured, commonly used and machine-readable format, and to transmit them to another controller.

How can you exercise your rights?

You may exercise your rights in relation to personal data via our contact details. All information and actions will be provided without undue delay.

We will do our utmost to accommodate you in protecting your personal data. However, if you are not satisfied with the handling of your request, you have the right to lodge a complaint with the supervisory authority, in particular the Office for Personal Data Protection (www.uoou.cz).

If, in particular, your habitual residence, place of work or place of the alleged infringement of personal data protection is outside the Czech Republic in another Member State of the European Union, you may contact the competent supervisory authority in that Member State.



4. Administration and Processing of Personal Data

Who processes your personal data?

We are the controller of personal data within the meaning of the Regulation.

To the extent necessary to perform the contract or other obligations, we are entitled to transfer your personal data to other persons, e.g., carriers, cloud storage providers, e-mail campaign administrators, the company providing the “Verified by Customers” certificate, external accountants, or other persons involved in performing the contract or our obligations. We may also appoint other processors and recipients of personal data.

Who specifically processes your personal data?

  • carriers (GLS)
  • hosting (Blueboard)
  • mailing (Ecomail)
  • accounting software (Money S5)

The above entities may act as our processors or as independent controllers (or jointly with us), depending on the nature of the service provided.

In connection with the use of services of Google LLC, personal data may be transferred to third countries, in particular to the USA, on the basis of standard contractual clauses pursuant to Article 46 GDPR or another appropriate mechanism under the GDPR.

How do we process personal data?

Personal and other collected data are fully secured against misuse. Personal data will be processed in electronic form by automated means or in paper form by non-automated means.



5. Cookies

What are cookies?

Cookies are text files stored on the computer or other electronic device of each visitor to the web interface, which enable the operation of the web interface.

If personal data are processed through cookies, we process necessary cookies without consent because they are required for the operation of the website and for providing the service you request. We process analytical and marketing cookies only on the basis of your consent given via the cookie banner. We use these cookies mainly for user support, improving our services including analysing user behaviour, and marketing.

What cookies does the web interface use and for what purposes?

The web interface uses session (temporary) cookies, which are automatically deleted when browsing of the web interface ends. It also uses persistent cookies, which remain on your device until they expire or until you delete them.

The cookies used by the web interface are as follows:

  • first-party cookies – these cookies are assigned to our website domain; they may include necessary cookies (processed without consent) and analytical cookies (processed only on the basis of your consent). These cookies may be temporary or persistent;
  • necessary cookies – enable navigation on the web interface and the use of basic functions, do not identify you, and do not constitute personal data;
  • performance cookies – used to analyse how the web interface is used; typically work with pseudonymised and aggregated data;
  • third-party cookies – these cookies are assigned to a domain other than our website domain, even when you are on our website; we use these cookies only on the basis of your consent and they allow us to analyse the website and display personalised advertising;
  • functional cookies – used to personalise content by remembering login details, geolocation, etc.; their use may involve the collection and processing of personal data;
  • targeting and advertising cookies – used to display targeted advertising on the web interface and outside it; their use may involve the collection and processing of personal data. We may also share information about how you use our website with our partners in social media, advertising and analytics.

Cookie-based services used

The web interface uses Google Analytics and possibly other services provided by Google LLC (hereinafter “Google”) and the Sklik service provided by Seznam.cz, a.s. These services work with information obtained through cookies.

Google Analytics is used to obtain statistical information about your use of the web interface. The cookie retention period varies depending on the type of cookies and settings; details are available in the cookie settings on the web interface.

Google Ads is used to identify you within Google’s adver­tising network and to retarget advertising (retargeting and remarketing). Cookies obtained by this service expire depending on browser settings, at the latest after 18 months, or until you manually delete them. Automated profiling is carried out for the purposes of targeted advertising. This processing has no legal effects and does not significantly affect you in a similar way.

Sklik.cz is used to identify you within Seznam.cz’s ad­vertising network and to retarget advertising (retargeting and remarketing). Cookies obtained by this service expire depending on browser settings, at the latest after 18 months, or until you manually delete them.
